General Conditions of Sale France Guitare applied to new and used products

Our store and our company have ceased their activity since December 31, 2024, following the voluntary cessation of their sole founder, at the origin of the site FranceGuitare.fr. We are carrying out a friendly liquidation of the last items still available in dormant stock. Consequently, the general conditions of sale are no longer applicable from January 1, 2025 until the definitive closure of the site, planned for the end of April 2025. Please note that requests for feedback, information by email or advice by telephone will no longer be processed. You can nevertheless contact thewebmaster of the wordpress/prestashop site on the contact area of the site.

It is previously specified that these conditions govern sales by https://www.franceguitare.fr/en/ of its products. France Guitare sells new and used products to a lesser extent. These general conditions of sale apply to the exclusion of all other conditions. The site is the exclusive property of https://www.franceguitare.fr/en/, in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the authorization of its owner. The customer acknowledges having read, at the time of placing the order, the general and specific conditions of sale stated on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relations between France Guitare and its customers. Both parties accept them without reservation. These general conditions of sale will prevail over any other conditions appearing in any other document, unless prior, express and written waiver.

Article 1 - Commercial Policy France Guitare

1.1 - Prices

  • The prices of our products are indicated in euros, all taxes included, excluding participation in processing and shipping costs ;

1.2 – Products

France Guitare sells spare parts for new or used electric guitars from the French or international market. Most of the parts sold are Fender® brand or licensed brands, belonging to or subcontracted by the group Fender Musical Instrument Corporation®, headquartered in the United States of America in Scottsdale, Arizona.

The sale of spare parts constitutes the essential part of the commercial activity of France Guitare which can nevertheless sell old second-hand guitars, as well as various accessories or equipment for use by guitarists and luthiers (tools, maintenance products, amplifiers, effects or musical accessories). The photographs illustrating the products do not form part of the contractual scope. If errors have been introduced, under no circumstances shall the responsibility of France Guitare cannot be engaged.

Article 2 – Order and Payment

Sales take place on the Internet at the following address (URL) https://www.franceguitare.fr/en/, by credit card or Paypal electronic wallet, by check or by immediate bank transfer. For the French overseas departments and territories and abroad, the customer must consult the pricing conditions in advance.

Given the prices charged and the margin generated on small parts, orders of less than €18 including tax excluding shipping costs cannot be processed for technical and logistical reasons. The site https://www.franceguitare.fr/en/ sells spare parts that are primarily aimed at professionals in the manufacturing or customization of Fender guitars. France guitare cannot process orders whose amount including tax is less than the shipping and processing costs.

The contractual information is presented in French and will be the subject of a confirmation including this contractual information at the latest at the time of delivery. https://www.franceguitare.fr/en/ reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order. Cancellation of a current order for a product ordered out of stock or awaiting supply (as indicated in the product description) will be processed and then refunded within a minimum period of 10 days to a maximum of 15 days, less transaction fees charged by Paypal which manages our online payment methods. . The cancelled order is refunded regardless of the time taken by the customer's financial institution to credit the refund to the customer's account.

As indicated in the customer's basket during the order validation process, an order paid via Paypal (excluding credit card) then cancelled outside the 14-day withdrawal period, will be refunded within 15 days following the refund request expressed by the customer and after deduction of the payment fees and commissions invoiced by Paypal (approximately 2% of the order amount excluding shipping costs).

Automatic recording systems are considered proof of the nature, content and date of the order. France Guitare confirms acceptance of the order to the customer at the email address provided by the customer at the time of ordering. The sale will only be concluded upon confirmation of the order, confirmed by sending an email to the customer and subject to receipt of the online payment.

Article 3 - Validation

You declare that you have read and accepted these general conditions of sale before placing your order. Validation of your order therefore constitutes acceptance of these General Conditions of Sale. Unless proven otherwise, the data recorded by France Guitare constitute proof of all transactions made on the site https://www.franceguitare.fr/en/ by its customers.

Article 4 - Availability

Our product offers and prices are valid as long as they are visible on the website and while stocks last. Our offers for new products are subject to stock availability. For products not stocked at the head office, our offers are subject to availability from our suppliers. In this context, information on product availability is provided to you when you place your order. This information comes directly from our suppliers and France Guitare could not be held responsible for any inaccuracies, errors or modifications provided by them.

In the event of product unavailability after placing your order, we will inform the customer by email or post upon receipt of the information from the supplier concerned, before final confirmation of the order. The order will be automatically cancelled and the customer will be immediately refunded if their bank account has been debited. The refund will appear on the customer's account no later than twenty to thirty days (20 to 30 days) from the payment of the sums paid by the customer.

Article 5 - Delivery

5.1 - General information

Products purchased on the website https://www.franceguitare.fr/en/ are only delivered to a few countries in the Eurozone and to the United Kingdom. After order confirmation, France Guitare undertakes to deliver via its carrier all the references ordered by the buyer. This carrier is contractually bound with France Guitare to deliver the order to the buyer's address provided by France Guitare.

For deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products, customs duties, value-added tax, and all other taxes due under the laws of the country where the order is received. All orders placed with France Guitare are intended for the personal use of customers, customers or recipients of the products are prohibited from any partial or total resale of the products. France Guitare is in fact released from any legal liability if the payment of taxes is not made by the customer. France Guitare is not responsible for customs clearance requests sent to customers in addition to or in addition to the declaration documents provided at the time of shipment. Deliveries to EEC countries authorized by France Guitare are carried out by La Poste in Colissimo "export" International Europe or in Chronopost depending on the customer's choice, France Guitare refuses to make any delivery outside the EEC and outside the list of countries offered by the automatic online ordering system on the Internet.

The following are considered force majeure events that relieve the seller of his obligation to deliver: war, riots, fire, strikes, accidents, and the impossibility of obtaining supplies. Goods always travel at the recipient's risk. The customer undertakes to check his package upon arrival. The customer has 48 to 72 hours to make any reservations with the carrier regarding damage.

The times indicated on the "Delivery times and costs" product sheets are the usual average times corresponding to the delivery times of suppliers, processing time, packaging and conditioning, and shipping to which is added the carrier's delivery time.

Products are delivered to the delivery address you specified during the order process. When you order multiple products at the same time and they have different shipping times, combined shipping takes precedence and the order shipping time is based on the longest time. https://www.franceguitare.fr/en/ reserves the right to split shipments. The total amount of the order will then be debited, including the amount of products that have not been shipped. The processing and shipping costs will only be charged once for a single shipment. https://www.franceguitare.fr/en/ cannot be held responsible for the consequences of a delay in delivery. The maximum delivery time is 16 days from the date the order is shipped (see Colissimo La Poste general terms and conditions of sale).

The delivery times indicated are average times and correspond to the shipping times (on the product sheet), to which are added the delivery times for products destined for mainland France and Monaco. Any order not shipped within 60 days of the order date will be cancelled and then refunded unless otherwise stipulated in the sales offer (or product sheet), or unless expressly requested by the customer.

The information provided by the buyer during the ordering process is his responsibility: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

5.2 - Delivery problems

You must notify the carrier upon receipt of the product and https://www.franceguitare.fr/en/ any reservations regarding the quality of the delivery and the quality of the delivered product (for example: damaged package, already opened, etc.) within 3 days of receiving the product. Depending on the cases defined in Article 13.1 below, you can benefit from the exchange and refund conditions provided for in this article. The carrier is responsible and the buyer must contact the carrier for any complaints related to the quality of the delivery. Any goods damaged during transport must be the subject of a claim filed with the postal services responsible for Colissimo shipments. France Guitare will do everything to help its customers obtain compensation from the carrier but under no circumstances France Guitare cannot replace the compensation provided for by the insurance taken out with the carrier. Only the carrier's insurance will allow the customer to be compensated for the value declared on the shipping slip issued by France Guitare with the Post Office services.

Goods purchased with a value exceeding €150 must be returned via a carrier that offers insured signature-on-delivery service. The cost of returning orders is the sole responsibility of the buyer. Whether the order is returned in full or in part, France Guitare does not cover the cost of packaging or shipping the return of the order.

Goods damaged during transport to the recipient which would be returned to France Guitare without prior authorization, will not be reimbursed or supported. The buyer must demonstrate loyalty and use the tools provided in their customer area to request a return authorization. If you have any problems handling a return or damaged delivery, customers can first contact customer service. Products shipped with delivery against signature which could not be, voluntarily or not, distributed or collected by the customer from the carrier within 15 days after the date of deposit of a delivery notice, will be automatically returned to France Guitare as agreed in the general conditions of sale of the carriers. Therefore, an order not collected and returned to France Guitare will be processed as a return within a minimum of 30 days, taking into account the return processing conditions imposed by the transport companies. Upon receipt of the order returned by the carrier, and without any specific instructions from the customer, the order will be automatically refunded less the shipping costs charged to the customer to process the initial shipment of their order on the date of purchase. If the customer wishes, France Guitare may resend the order under the same conditions but by re-invoicing the shipping and processing costs of the package.

Article 6 - Payments France Guitare

Payment for your purchases must be made in Euros by bank card via the secure Paypal payment system or by bank card (cards accepted Visa, MasterCard, American Express, etc.). The bank card payment system used on the website https://www.franceguitare.fr/en/ is the world's leading secure payment system PayPal®. This system is used by millions of merchants worldwide. PayPal is responsible for the entire process involving the customer's bank account. France Guitare does not keep any confidential banking information or bank card information of its customers.

PayPal is responsible for the entire debit-credit procedure occurring on the bank account of customers of France Guitare which cannot be held responsible for any malfunction of the online payment system. Your credit card number is directed to the banking servers managed by Paypal, your payment is made directly to a bank in a secure environment without going through our store's server. Payment by PayPal® credit card offers the buyer a guarantee of reimbursement of the purchase in the event of non-delivery of the product (see conditions on the site www.paypal.fr).

The order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by the said centers, the order will be automatically placed on hold and then deleted. The buyer will be notified by email. Furthermore, France Guitare reserves the right to refuse any order from a customer with whom there is a dispute.

For items purchased on pre-order or on backorder, the customer's bank card may be debited up to five working days before the order is shipped.

France Guitare reserves the right to change its credit card payment system at any time. Credit card payments are managed byPayPal®, for all types of credit card payments.

Article 7 - Reimbursement

The refund of products returned in the cases referred to in articles 5 and 8 will be made within a period of less than or equal to 15 days after receipt of the products by us. The refund will be made at the choice of https://www.franceguitare.fr/en/ by credit made by Paypal to the bank account in the name of the customer who validated the order sent to their billing address. No cash on delivery shipments will be accepted for any reason.

Article 8 - Satisfied or refunded

Throughout the Eurozone, you have a 30-day cooling-off period instead of 14 days from the date of receipt to return the product(s) ordered. Products must be returned before the end of the 30-day period and the return costs are then borne by the customer.

Satisfaction guaranteed or your money back does not mean that France Guitare finances a "good to see or try" at its expense on low-value parts, the return processing costs and shipping costs of the returned order remain the responsibility of the customer.

This right of return may only be granted for products that have not been used, in their original condition and packaging, returned complete and in the same condition as when sent (packaging, accessories, instructions, etc.), accompanied by a copy of the purchase invoice or the return slip provided in the return confirmation email or downloadable from your customer area. The customer must first contact and notify France Guitare via the returns management tools available in their customer area in the “order history” section.

Items returned incomplete, without packaging, damaged, soiled, or diverted from their function or no longer technically corresponding to the one initially shipped, will not be taken back or refunded and will be returned to the customer as is. This is particularly the case for single-use electronic parts which, once assembled, cannot be resold or reused. Items returned to France Guitare items with a value exceeding €100 must be returned using a delivery service requiring signature with insurance (shipping type "Colissimo requiring signature"). Upon validation of your return by customer service, if a refund is desired, the refund will be made directly to your bank account by automatic transfer within 12 to 15 days upon receipt of the returned products.

Orders returned under the right of withdrawal will be fully refunded if the customer so wishes and only if the order was shipped at the standard rate by the least expensive carrier offered by FranceGuitare (generally Colissimo against signature).

For orders shipped via Express mode via DHL/UPS/chronopost, the right of withdrawal does not cover the shipping costs initially paid at the time of ordering. The order will be refunded less the shipping costs for sending the order. The shipping costs for returning the order remain the responsibility of the buyer.

For all orders returned under the right of withdrawal, containing fragile products, or requiring technical inspection and repackaging of the products for resale, return administration/processing fees will be deducted from the refund. These fees are a fixed amount of €6 including tax for orders returned from mainland France, and €9 for orders delivered and returned from other destinations (i.e. outside mainland France).

The initial shipping costs of the order as well as the administration fees will be deducted from the refund of all international orders shipped to the Eurozone returned for withdrawal, including outside the Eurozone free of charge (Overseas Departments and Territories, French Polynesia, Norway, Finland, Poland, Sweden, Denmark, Estonia, Hungary, etc.).

As part of your right of withdrawal, you may request an exchange for a different or equivalent product of equal value. In this case, FranceGuitare will cover the shipping costs for sending the product(s) ordered in exchange for the returned product(s).

Article 9 - Security

Our site is subject to a security system. We have adopted the group's online payment process Paypal® to protect all sensitive data related to payment methods as effectively as possible. Article 13 - Guarantee

13.1 - Legal guarantee

France Guitare sells branded spare parts, both new and used. New products benefit from a one-year legal warranty from the date of receipt, provided they are not damaged by the user: we are talking about guitar parts, electronics, and not hair dryers or mobile phones. Spare parts for new or used guitars do not come with any warranty.

The customer has the right to withdraw within 30 days of receipt of the product, provided that the product has not been damaged upon receipt.

Guitar parts that have been tried and damaged by the customer will not be returned or refunded, especially guitar necks and bodies, and any part that shows signs of wear or use. All dimensions are indicated in the product descriptions to help the customer make the right choice. Everyone is responsible for what they do with guitar spare parts that are considered fragile. Spare parts most of the time require the intervention of a knowledgeable professional capable of respecting their use and destination. Any improper, improvised use or use that does not respect professional rules of use cannot claim to be guaranteed.

The warranty does not cover bodies or handles that have been damaged due to improper handling, for example. The product description being authoritative, if the product is sent second-hand and damaged, the defects of the part(s) will be indicated in the description of the products concerned, otherwise the product is always considered new or in excellent condition not deserving the description of particular damage. Guaranteed products must be returned to us complete in the condition in which the customer received them with all elements (accessories, packaging, instructions, etc.). The customer agrees to respect the return conditions of these general conditions and its article 8. It is useful to remember that France guitare checks the conformity of all products sold on the site https://www.franceguitare.fr/en/ with the use that must be made of it.

The warranty only applies if a defect has escaped the conformity check by the manufacturer's technical support or France Guitare. . This is the case, for example, for microphones and electronic parts that are checked before shipping. Microphones are fragile and can be damaged during assembly or transport. Most microphones are only guaranteed if assembled by a professional approved by the manufacturer and will not be returned or exchanged. Otherwise France Guitare reserves the right to check the parts before accepting the return and possible refund from the customer. This also applies to pre-wired plates (Loaded Pickguard type): These are checked, tested and controlled before sending, the customer is therefore responsible for the assembly and its consequences in the event of failure.

The provisions of this article do not prevent the customer from benefiting from the right of withdrawal provided for in article 8.

13.2 - Contractual guarantee

Products purchased on https://www.franceguitare.fr/en/ may be entitled to a one-year warranty with the exception of used products or spare parts for a guitar. All products sold on this site and coming from the second-hand market with a manufacturing date of more than one year cannot be guaranteed. The legal warranty and/or the manufacturing date of the product are indicated in each of the respective product sheets presented on the site. Disassembled Fender® guitar parts (necks, bodies, and pre-wired, loaded pickguards) are not covered by the manufacturer's warranty.

To find out the steps to follow regarding after-sales service for any problem or breakdown with a product, you can contact Customer Service, the contact details of which are provided in article 10 of these general conditions. To benefit from the product warranty, it is essential to keep the product purchase invoice; the order form alone is not sufficient. In all cases, France Guitare cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country, the responsibility of France Guitare is systematically limited to the value of the product in question, value on its date of sale and without the possibility of recourse against the brand or the company producing the product.

The contractual guarantee does not cover:

  • Replacement of consumables (screws, ropes, latex, plastic or bakelite parts, copper wire, etc.) ;
  • Abnormal or improper use of the products. In this regard, we invite you to carefully consult the instructions for use provided with the products, or to refer to our customer support and not to "your professional luthier" in the event of doubt about the use or quality of the product ;
  • Defects and their consequences due to the intervention of an external person or a repairer/luthier not approved by https://www.franceguitare.fr/en/. More generally, the handling of a piece of lutherie sold and handled or assembled by a so-called "professional" luthier cannot be covered by any guarantee, we are not dependent on so-called external knowledge or knowledge superior to that of our own luthiers ;
  • Defects and their consequences linked to use not in accordance with the use for which the product is intended (professional use, collective use, shock during use, inappropriate use, etc.) ;
  • Used products from abroad ;
  • Products damaged during transport from France Guitare and to the recipient customer's home ;
  • Returned damaged goods are not guaranteed and are not covered ;
  • Used Fender® brand lutherie parts (body, necks and electronics) ;
  • New custom-made lutherie parts manufactured under Fender® license in USA ; ;
  • Modified or worked lutherie parts which are no longer in their original condition at the time of sale ;
  • Electronic parts mounted and already soldered on a guitar electrical circuit or showing traces of soldering: these are checked before shipping, it is the customer's responsibility to check that they are working properly before assembling their electronic circuit to ensure that the part has not been damaged during transport ;
  • Fender guitar and bass pickups mounted, assembled or soldered by a third party not authorized by Fender.

However, in any event you benefit from the provisions of the legal guarantee, in particular those relating to the legal guarantee specified in article 13.1 above.

Article 14 - Applicable law - Disputes

This contract is subject to French law. France Guitare cannot be held liable for damages of any kind, whether material, immaterial or physical, which may result from malfunction or improper use of the products sold. The same applies to any modifications to the products resulting from manufacturers or customers.

The responsibility of France Guitare will, in any event, be limited to the amount of the order and cannot be held responsible for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.

In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a consumer association or any other advisor of his choice.

It is recalled that the search for an amicable solution does not interrupt the period of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes:

  • That the buyer honors his financial commitments to the seller ;

Failing this, the Commercial Court of Bordeaux shall have sole jurisdiction, regardless of the place of delivery and the accepted payment method. This contract is subject to French law. Article 15 - Personal information

The information and data concerning you are necessary for the management of your customer account, your order and our business relations. They may be transmitted to companies that contribute to these relations, such as those responsible for the execution of orders and deliveries, for their management, execution, processing and payment. Article L211-4 Consumer Code

The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity that exists at the time of delivery.
